Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, APIs, SDKs, documentation, and related services provided by DataBlue ("DataBlue", "we", "us", or "our") (collectively, the "Services"). Please read them carefully — they are a binding contract between you and DataBlue.

1. Agreement to Terms

By creating an account, generating an API key, or otherwise accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. If you do not agree to these Terms, do not use the Services.

2. The Services

DataBlue provides an API that returns structured search and web data — including Google SERP results, scraping, crawling, mapping, and extraction endpoints — along with SDKs, an MCP server, and a dashboard. We may add, change, or remove features over time. We'll give reasonable notice of material changes that adversely affect your use, where we can.

You are solely responsible for ensuring that your specific use of the data you obtain through the Services complies with the laws, regulations, and terms that apply to you and to the sources you target.

6. Customer Data & Responsibilities

"Customer Data" means the queries, URLs, parameters, and results you submit to or receive from the Services. As between you and us, you retain all rights to your Customer Data. You grant us a limited license to process Customer Data solely to provide, secure, and improve the Services. Where we process personal data on your behalf, our Data Processing Agreement applies. You represent that you have the necessary rights and lawful basis to submit your Customer Data and to obtain the data you request.

7. Intellectual Property

The Services, including our software, SDKs, documentation, branding, and the look and feel of the website, are owned by DataBlue and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms. You may not copy, modify, reverse engineer, or create derivative works of the Services except as permitted by law or an applicable open-source license. Any feedback you provide may be used by us without obligation to you.

8. Third-Party Services & Content

The Services fetch publicly accessible content from third-party websites and search engines that we do not own or control. We do not endorse and are not responsible for that content, and the availability or structure of third-party sources may change at any time. The Services may also integrate with third-party tools (such as payment processors and cloud providers) governed by their own terms.

9. Availability & Support

We work hard to keep the Services available and performant, and we publish uptime on our status page. Service-level commitments, where offered, are described in your plan. The Services are otherwise provided on an "as available" basis, and we may perform maintenance or experience downtime from time to time.

10. Suspension & Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure for us, or use the Services in a way that harms the platform or other users. We may also suspend accounts for non-payment. Upon termination, your right to use the Services ends, and provisions that by their nature should survive — including payment obligations, intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE, COMPLETE, OR CURRENT, AS THEY DEPEND ON THIRD-PARTY SOURCES OUTSIDE OUR CONTROL.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATABLUE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless DataBlue and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your Customer Data, or your violation of these Terms or any applicable law or third-party right.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, and the courts located in Madurai, Tamil Nadu, India will have exclusive jurisdiction over any dispute, except where mandatory local law provides otherwise. We will always try to resolve disputes informally first — please reach out before pursuing formal action.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Services or by email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
